Rental agreement and terms

This is the agreement you accept when you book. It covers what you are renting, what it costs, what happens if something goes wrong, and what each of us is responsible for.

This Rental Agreement and Terms ("Agreement") is between Good Day Moving Bins ("Good Day," "we," "us," or "our") and the person or entity identified in the reservation ("Customer," "you," or "your").

By electronically accepting this Agreement and completing a reservation, you agree to the following terms.

1. Rental equipment

Good Day rents reusable plastic moving boxes, sometimes commonly referred to as moving bins or moving totes, together with dollies and related moving equipment.

For purposes of this Agreement, "Moving Boxes" means the reusable plastic moving boxes/bins/totes rented by Good Day. "Equipment" means collectively all Moving Boxes, dollies, and any other equipment or accessories provided by Good Day as part of the Customer's rental.

The Equipment quantity, rental dates, delivery and pickup information, price, and other reservation-specific details shown in your booking confirmation are incorporated into this Agreement.

All Equipment remains the property of Good Day at all times. Renting Equipment does not transfer ownership or any ownership interest to Customer.

2. Rental period

Your rental begins on the scheduled delivery date and ends on the scheduled pickup date shown in your reservation.

Equipment must be available for pickup on the scheduled pickup date unless Good Day has approved an extension.

Keeping Equipment beyond the agreed rental period does not automatically extend the rental.

3. Rental extensions

Extensions may be available depending on upcoming reservations and must be requested and approved by Good Day at least 24 hours before the scheduled pickup date.

Good Day texts a pickup reminder to the mobile number on the reservation about 48 hours before the scheduled pickup. If you are not going to be ready, reply to that text and we will price an extension for you then.

The price and new pickup date will be disclosed before you confirm an extension. Current extension pricing ranges from $40 to $85 per additional week depending on package size, as disclosed during booking or when the extension is requested.

Good Day will not automatically renew a rental or charge you for an optional extension without your affirmative agreement.

Failure to make Equipment available for pickup is not an approved extension and may result in the charges described in the Failed Pickup section of this Agreement.

If a scheduled pickup has already been missed, Customer may still request a paid extension. If Good Day approves it, any extended-inventory charges already incurred for that order will be credited toward the extension price.

4. Delivery and pickup

Customer must provide complete and accurate delivery and pickup information and provide Good Day with safe and reasonable access to the designated location.

Someone 18 years or older must be present for delivery and pickup, or Customer must arrange a safe, accessible spot with Good Day in advance. Equipment is left at the nearest accessible point outside.

Customer is responsible for obtaining any necessary permission for Good Day to access apartment communities, gated properties, parking facilities, loading areas, private property, or other restricted locations.

Please tell us in advance about known access conditions that could materially affect delivery or pickup, including restricted parking, security procedures, construction, significant stairs, locked gates, or other unusual obstacles.

Good Day may decline to enter or access an area that reasonably appears unsafe, unlawful, inaccessible, or likely to cause injury or property damage.

Customer agrees to keep children, pets, vehicles, and other hazards reasonably clear of the delivery and pickup area.

Delivery and pickup are included within Good Day's standard service area as disclosed during booking. Current distance surcharges are $20 per affected trip for locations 10 to 20 miles from City Heights. Locations beyond 20 miles require a quote and approval before booking.

5. Your responsibility for the equipment

Customer assumes responsibility for the Equipment upon delivery and remains responsible for it until it has been returned to and accepted by Good Day.

Customer agrees to take reasonable care of the Equipment and protect it from loss, theft, destruction, misuse, excessive contamination, and damage beyond ordinary wear and tear.

Customer may not sell, sublease, abandon, intentionally damage, materially alter, remove identifying asset labels or barcodes from, or otherwise dispose of Good Day Equipment.

Please notify Good Day promptly if any Equipment is lost, stolen, materially damaged, or otherwise unavailable for return.

6. Using the moving boxes

Moving Boxes are intended for ordinary residential or commercial moving, packing, temporary storage associated with a move, and other uses expressly approved by Good Day.

Customer is responsible for determining whether an item is appropriate to place inside a Moving Box and for packing belongings safely.

Moving Boxes may not be overloaded or packed in a manner that makes them unsafe to lift, stack, transport, deliver, or retrieve.

Good Day may decline to move or retrieve an overloaded or unsafe Moving Box until sufficient contents have been removed to allow safe handling.

7. What cannot go in the moving boxes

Moving Boxes may not be used to store or transport:

  • Illegal or stolen property
  • Hazardous, explosive, flammable, corrosive, toxic, radioactive, or otherwise dangerous substances
  • Gasoline, propane, fireworks, ammunition, or similar hazardous materials
  • Wet materials or substances likely to leak
  • Food of any kind, open or sealed. This protects the next renter, who may have allergies
  • Live plants
  • Animals, insects, or other living organisms
  • Medical, biological, or hazardous waste
  • Items whose possession or transportation violates applicable law
  • Materials reasonably likely to damage the Moving Boxes, other property, persons, or Good Day personnel

Customer is responsible for reasonable damages, cleaning, remediation, or replacement costs resulting from prohibited contents, subject to applicable law.

8. Customer belongings

Good Day rents reusable Moving Boxes and related Equipment. Unless Good Day expressly agrees otherwise in writing, Good Day is not acting as a mover, warehouse, or storage provider for Customer's personal belongings.

Customer is responsible for packing, protecting, loading, unloading, securing, transporting, storing, and insuring Customer's belongings.

Good Day does not take custody of or assume responsibility for the contents placed inside Moving Boxes.

To the fullest extent permitted by California law, Good Day is not responsible for loss of or damage to Customer's belongings resulting from Customer's packing, handling, transportation, storage conditions, use of the Equipment, acts of third parties, theft, weather, or other circumstances outside Good Day's reasonable control.

Nothing in this Agreement releases Good Day from liability that cannot lawfully be waived or limited.

9. Lost, stolen, unreturned or damaged equipment

Customer is responsible for Equipment that is lost, stolen, destroyed, not returned, or damaged beyond ordinary wear and tear while under Customer's responsibility, except to the extent caused by Good Day or where applicable law provides otherwise.

Ordinary wear and tear means deterioration reasonably resulting from normal intended rental use.

Ordinary wear and tear does not include substantial cracks, punctures, melted or burned areas, missing components, excessive contamination, intentional alteration, removed asset labels, or damage resulting from misuse or prohibited contents.

If Equipment cannot reasonably be returned to rental service, Good Day may charge the applicable replacement amount together with directly related costs permitted by law.

Current replacement amounts are:

  • Moving Box: $20 each
  • Dolly: $50 each
  • Other Equipment: the reasonable replacement amount disclosed with the applicable item

For repairable damage, Good Day may charge the reasonable actual cost of repair or remediation.

Good Day will not charge Customer for ordinary wear and tear.

10. Cleaning

Normal cleaning between rentals is included in your rental price.

Additional charges may apply when Equipment is returned with contamination requiring cleaning or remediation materially beyond Good Day's normal turnover process, including paint, adhesives, oils, chemicals, animal waste, food residue, pests, strong persistent odors, or prohibited substances.

Any additional cleaning or remediation charge will be reasonably related to the additional work or expense required.

11. Inventory and asset tracking

Good Day may individually identify Moving Boxes, dollies, and other Equipment using asset numbers, barcodes, QR codes, or similar inventory-control methods.

Good Day's checkout and return records may be used to determine which Equipment was delivered and returned.

If you believe there is an inventory discrepancy, please contact Good Day. Customer may request that Good Day review its records before a missing-Equipment charge is finalized.

12. Payment authorization

Customer authorizes Good Day to charge the payment method selected during checkout for: (1) the rental and services purchased during booking; (2) extensions affirmatively requested and approved by Customer; (3) other charges affirmatively authorized by Customer; and (4) amounts properly due under this Agreement for lost, stolen, unreturned, damaged, excessively contaminated, failed-pickup, extended-inventory, additional-trip, or otherwise chargeable Equipment or services.

Before imposing a post-rental charge, Good Day will provide Customer with a description of the charge and the basis for it.

Nothing in this Agreement authorizes Good Day to impose a charge prohibited by applicable law or Customer's applicable payment-network rights.

13. Cancellations, rescheduling and refunds

Cancellations made at least 48 hours before the scheduled delivery are eligible for a full refund. Cancellations made within 48 hours of the scheduled delivery are subject to a $60 cancellation fee. After delivery, the rental is non-refundable.

If Good Day cancels a reservation because Good Day cannot provide the reserved Equipment or service, Customer will receive a refund of amounts paid for the portion Good Day cannot provide unless Customer affirmatively agrees to an alternative arrangement.

Refunds will be issued to the original payment method when reasonably practicable.

14. Weather, emergencies and unexpected events

Good Day may reasonably delay or reschedule delivery or pickup because of severe weather, wildfire, flooding, road closures, government orders, accidents, emergencies, vehicle breakdowns despite reasonable maintenance, natural disasters, or other circumstances outside Good Day's reasonable control.

Good Day will make reasonable efforts to notify Customer and arrange an alternative delivery or pickup time.

Nothing in this section eliminates obligations that applicable law does not permit Good Day to disclaim.

15. Property access and ordinary delivery risks

Customer understands that delivery and pickup of Equipment involves ordinary risks associated with carrying, rolling, loading, unloading, and moving Equipment through driveways, walkways, parking areas, entrances, stairs, and other access areas.

Customer is responsible for identifying known hazards or unusual property conditions that are not reasonably apparent to Good Day.

Customer agrees to take reasonable precautions to provide a safe and accessible delivery and pickup area.

16. Limitation and release of liability

Please read this section carefully. It affects your legal rights.

To the fullest extent permitted by California law, Customer releases Good Day and its owners, employees, contractors, and agents from claims arising solely from the ordinary and reasonably foreseeable risks inherent in Customer's possession, packing, loading, transportation, storage, and use of the rented Equipment, except to the extent caused by Good Day's negligence or other conduct for which liability may not lawfully be excluded.

Nothing in this Agreement releases, waives, limits, or excuses liability for fraud, willful misconduct, gross negligence, violation of law where liability cannot lawfully be waived, or any other liability California law prohibits the parties from waiving or limiting.

Nothing in this Agreement is intended to waive any right or remedy that cannot legally be waived.

17. Customer responsibility for third-party claims

To the extent permitted by California law, Customer is responsible for claims, losses, injuries, or property damage resulting from Customer's unlawful use, misuse, prohibited use, or unauthorized disposition of the Equipment.

This provision does not require Customer to indemnify Good Day for losses caused by Good Day's negligence, gross negligence, willful misconduct, fraud, or other conduct for which indemnification may not lawfully be required.

18. Moving box recommendations

Good Day may provide estimates or recommendations regarding the number of Moving Boxes appropriate for a move.

These recommendations are estimates only. Actual needs vary depending on the quantity and type of belongings, packing style, household size, home size, and other circumstances.

Good Day does not guarantee that a recommended quantity will be sufficient for every Customer.

19. Communications

Customer agrees that Good Day may send transactional communications reasonably necessary to administer the reservation, including booking confirmations, delivery and pickup information, reminders, receipts, service updates, and communications concerning Equipment or payment.

Marketing communications, if any, will be handled separately and subject to applicable consent and opt-out requirements.

20. Electronic agreement and records

Customer agrees to conduct this transaction electronically.

By selecting the acceptance control presented during checkout and completing the reservation, Customer intends to electronically sign and enter into this Agreement.

Good Day may maintain an electronic record of Customer's acceptance, including information supplied during booking, booking number, date and time of acceptance, Agreement version, and related transaction information.

Customer will receive or be provided electronic access to a copy of the Agreement applicable to the reservation.

21. Changes to these terms

The Agreement governing a reservation is the version accepted by Customer when that reservation is completed.

Good Day may update these Terms for future rentals.

A later update will not retroactively modify the Agreement governing an existing reservation unless both parties agree to the modification or applicable law requires otherwise.

22. Governing law

This Agreement is governed by the laws of the State of California.

Any dispute is subject to the jurisdiction and venue rules otherwise applicable under California law.

Nothing in this Agreement requires Customer to waive a venue, forum, small-claims right, consumer protection, or other procedural right that cannot lawfully be waived.

23. Severability

If any provision of this Agreement is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate.

The remaining provisions will continue in effect to the extent permitted by law.

24. Entire agreement

This Agreement, Customer's booking confirmation, and any policies expressly incorporated into the Agreement at the time of booking constitute the agreement between Customer and Good Day concerning the rental.

If the booking confirmation conflicts with this Agreement regarding transaction-specific information such as quantity, dates, delivery or pickup location, or price, the booking confirmation controls as to that information.

25. Customer eligibility and authority

Customer represents that they are at least 18 years old and legally capable of entering into this Agreement.

If Customer is making a reservation on behalf of a business, organization, or another legal entity, Customer represents that they are authorized to enter into this Agreement on that entity's behalf.

26. Transfer of equipment

Customer may not sell, sublease, rent, transfer, abandon, or provide Good Day Equipment to another person, household, or business without Good Day's prior approval.

Equipment may not be moved to a delivery or pickup address different from the address associated with the reservation without notifying Good Day and receiving approval for the change.

Customer remains responsible for the Equipment until it has been returned to and accepted by Good Day.

27. Customer belongings left in moving boxes

All Moving Boxes must be completely emptied before the scheduled pickup.

Good Day does not accept custody or storage of Customer's personal belongings.

If Customer's belongings remain inside a Moving Box at the scheduled pickup, Good Day may decline to retrieve that Moving Box until it has been emptied.

Customer remains responsible for the Equipment until it is successfully retrieved and accepted by Good Day.

If Good Day inadvertently retrieves a Moving Box containing Customer property, Good Day will make reasonable efforts to notify Customer and arrange for return of the property. Customer may be responsible for reasonable additional delivery or retrieval costs resulting from property left inside the Equipment.

Nothing in this section permits Good Day to dispose of Customer property except as permitted by applicable law.

28. Failed pickup and additional pickup attempts

Customer must have all Equipment empty, accessible, and ready for retrieval during the agreed pickup period.

If Good Day cannot complete a scheduled pickup because Equipment is unavailable, inaccessible, not emptied, or otherwise not ready for retrieval due to circumstances within Customer's reasonable control, Customer may be charged a $50 failed-pickup fee. This fee is charged once per scheduled pickup, not per attempt.

Beginning the day after the failed scheduled pickup, a $25 per day extended-inventory charge may apply to the entire order until the Equipment is made available for pickup.

Customer may end the extended-inventory charge at any time by requesting a paid weekly extension. If Good Day approves it, extended-inventory charges already incurred for that order will be credited toward the extension price.

Customer is also responsible for the cost of the additional pickup trip: $25 per additional pickup attempt, plus any applicable distance charge for addresses more than 10 miles from City Heights.

If Customer's failure to return Equipment causes Good Day to incur a documented actual loss, including a lost confirmed reservation, Good Day reserves the right to seek recovery of that documented actual loss to the extent permitted by California law.

Customer remains responsible for the Equipment until it has been returned to and accepted by Good Day.

29. Photographs and condition documentation

Good Day may reasonably photograph or otherwise document Equipment and relevant delivery or pickup conditions for purposes including inventory verification, documenting Equipment condition, documenting delivery or return, resolving damage or missing-Equipment claims, and addressing customer-service or payment disputes.

Good Day will not use photographs of Customer's private property or belongings for advertising or promotional purposes without separate permission.

30. Customer contact information

Customer agrees to provide accurate contact information, including a working telephone number and email address, and to keep that information reasonably current during the rental period.

Customer is responsible for monitoring reasonable transactional communications from Good Day concerning delivery, pickup, Equipment, payment, or the reservation.

Failure to receive a communication because Customer supplied inaccurate or outdated contact information does not eliminate Customer's responsibilities under this Agreement.

31. Additional moving boxes vs. replacement charges

Additional Moving Boxes are currently available at $5 each, subject to availability. This is a rental charge only.

The additional-box rental price does not represent the purchase price, value, or replacement cost of a Moving Box.

A Moving Box that is lost, stolen, destroyed, unreturned, or damaged beyond ordinary wear and tear may be subject to the separate $20 replacement charge stated in this Agreement.
